An additional problem is that Fair Isaac, Trans Union and Equifax are not clear about WHICH dates they are using to age collections and charge-offs.

I would greatly appreciate any letters from collection agency and creditor executives in support of changes to credit scoring and reporting practices.

And of course, donations are accepted.

I'm planning to go to Dallas this weekend (Sept 16th-18th) to attend the Richard Cornforth Seminar which will be held at the Holiday Inn Select Central.

I'll be leaving Oklahoma City on Friday about 8 a.m. and should get into Dallas in about 4 to 5 hours depending on lots of things I can't foretell. (LOL)

Its about 3 hours 45 minutes actual driving time so not counting possible flat tires or whatever, I'd ought to make it about noon or so.

There is a group supper at the motel Friday night so I'll be attending that as well.

Most of you won't even know I'm gone because I'll be available by phone at all times and I'll be on the internet via cellphone or wireless network at least some of the time.

I'm hoping to meet anyone coming to the seminar or living in the Dallas area that would like to visit with me while I'm there.

Don't know where I'll be staying as of yet. Might not know until I get there.
I really can't afford to spend the $89 a night to stay at the Holiday so will probably look for something cheaper than that.

CORNYN FILES SUIT TO CLOSE DEBT COLLECTION AGENCIES
Three Houston-Area Companies Cited for Illegal Solicitations and Services

HOUSTON - Texas Attorney General John Cornyn received a temporary restraining order (TRO) to close three fraudulent Houston-area debt collection agencies. The petition for TRO, which cites individuals affiliated with the companies, also requests the freezing of certain bank accounts and the forfeiture of funds.

Involved in criminal search warrants in this cooperative enforcement case were the Harris County District Attorney's office and the Federal Bureau of Investigation.

The defendants named are Rudolph Stearnes III, William Ficka III and Kyle Holder, with their respective companies - Campbell, Campbell, Drexler & Gates; Thomas, Thomas, Alexis & Lynn; and Ashton, Ashton, O'Riley & Schwartz.

"The allegations in this case paint a picture of three people who brazenly harmed numerous individuals and businesses in Texas and all across the country using fraudulent and empty debt collection promises," said Attorney General Cornyn. "We contend that they passed themselves off as attorneys in legitimate law firms, then proceeded to collect money from debtors without returning this money to the creditors."

According to allegations in the petition filed today, these companies sent unsolicited faxes across the country in an effort to attract debt collection business from creditors experiencing problems with collections. State law requires that debt collection agencies be bonded, while these were not. Also, sending unsolicited faxes violates federal law.

Representing themselves as attorneys, the individuals named in the suit allegedly solicited companies for credit files. When they obtained these, they used extreme methods of telephone intimidation to coerce the debtors into payment, then once they collected this debt, they allegedly never reimbursed their clients, the creditors. In turn, the defendants quickly changed addresses and phone numbers to avoid detection.

The Attorney General's Consumer Protection Division has alleged that the companies committed numerous violations of the Deceptive Trade Practices and Consumer Protection Act, including causing confusion or misunderstanding about sources or affiliations of goods or services, and representing that goods or services have approvals, sponsorships or standards, when in fact they do not.

The companies also are charged with several violations of the Debt Collection Act, including prohibitions against harassment and profanity, according to the petition.

I call all debt collectors n*gg*rs too. That is not because of the color of their skin but rather the blackness of their hearts and minds. I also call them scumbags, thieves and liars. That is what this conversation is all about, not Billie Bauer or creditwrench or any of the stuff you holler about.

Stay on topic fool. The conversation isn't about Magna Carta or the Queen of England either. The topic is about abusive debt collectors and their sleaze bag operations which they call a "business" or a "profession" and which you want to defend but which you cannot do so you turn to slurs, slams, harassemt and other such garbage in an effort to keep the conversation from going where it is supposed to be going.

The topic is about sleazebag debt collectors who abuse people such as this poor woman left to raise 5 kids and fighting dirtbag debt collectors who attempt to tell her she can be thrown in jail and her kids sent to foster homes, driving her to the point of contemplating suicide.

That is what this is all about.

Now then, let's see how much of a patriot Uncle Normie is. From the following we can easily see that not only does he not know his history, he obviously does not understand the significant role that the GREAT MAGNA CARTA played in shaping our beloved Declaration of Independence and our Constitution nor does he know or understand that the MAGNA CARTA and the rights it guarantees to the citizens of England to this very day but it has also been the foundation stone upon which the rights of all citizens throughout the free world. Every free world nation in existance today has in one way or another incorporated the principles, beliefs and values that the Magna Carta proclaims for all free men everywhere. He is obviously so poorly educated that he does not know that all Americans were subjects of the English crown until the Declaration of Independence was adopted by the Second Continental Congress on July 4th, 1776.

He is most unlikely unaware that George Washington was not our first president. I'll bet he does not know that the following great men were our presidents prior to George Washington.

Drafted by Thomas Jefferson between June 11 and June 28, 1776, the Declaration of Independence is at once the nation's most cherished symbol of liberty and Jefferson's most enduring monument.

The violations of English Common Law in the American Colonies by King George, provided Thomas Jefferson with ample argument in writing his declaration of independence from the monarchy.

Such Revolutionary War era principles as habeas corpus and the wrongness of taxation without representation drew their roots from English Law of the 17th century that was based upon the Magna Carta. King George had violated these laws...in effect placing his decisions above the law of the land, and this gave the Colonists not only the right to seek freedom, but a responsibility to do so.

Not only did the Magna Carta become a "springboard" for Jefferson's revolutionary Declaration of Independence, the concepts of LAW as supreme (above even kings or legislative bodies) were drafted into the United States Constitution by James Monroe. The Bill of Rights, and specifically the 5th and 6th Amendments, find their heart and even their verbiage in the words of The Great Charter. Born in England in the 13th Century, the Magna Carta is arguably American as it is British.

On July 4, 1776, the Second Continental Congress unanimously adopted the Declaration of Independence. The Constitution provides the legal and governmental framework for the United States, however, the Declaration, with its eloquent assertion "all Men are created equal," is equally beloved by the American people. Until such time as the Second Continental Congress convened and adopted the Declaration of Independence, America was a subject of the British Crown.

The Federal Convention convened in the State House (Independence Hall) in Philadelphia on May 14, 1787, to revise the Articles of Confederation. Because the delegations from only two states were at first present, the members adjourned from day to day until a quorum of seven states was obtained on May 25. Through discussion and debate it became clear by mid-June that, rather than amend the existing Articles, the Convention would draft an entirely new frame of government. All through the summer, in closed sessions, the delegates debated, and redrafted the articles of the new Constitution.

On September 25, 1789, the First Congress of the United States therefore proposed to the state legislatures 12 amendments to the Constitution that met arguments most frequently advanced against it.

All of the above are important facts in our great history which Uncle Normie obviously knows nothing about yet he has the temerity to make the following dumb statements and hope to palm it off on his unsuspecting audience as being truth.

CREDITWRENCH CEO Bill Bauer was noticeably absent from internet postings for the last week or so. Quite out of character for him.

My sense is that, because of his recent financial difficulties, his ISP disconnected him. I say this because, as quickly as he left, he came back online the 1st of the month. That's when he gets his social security check.

I was never off line, have never been off line since 1982 and won't be off line until long after I am dead and gone. Count on that. I wasn't off line at all even when I was on a jet airplane headed to the East Coast nor when I was there nor when I was enroute back home.

The truth is that I told you on your holdings message board that I can crank you up on the weekends and you will spit and sputter over it all week long while I do other things. The truth is that I keep pitchin 'em and you keep missin 'em.

The truth is that you wouldn't know the truth if it bit you in your butt. The truth is that all you know how to do is to spam and cybersmear, twisting what someone says into a grotesque misrepresentation of what was actually said or intended.

You are a real piece of work to say the least. You don't know how to build a website, you don't know how to get links, you don't know how to build a website or much of anything else except how to spam 120,000 newsgroups.

Concerned Citizen has just been kind enough to provid me with a link to one of his 120,000 spam messages which he falsely claims he didn't do. I have pretty well cleaned up most of the more offensive language the other members of the newsgroup used in telling him what they thought of him and his spamming of their news group. Had they been able to get a physical hold on the louse they probably would have used something a bit more forceful to teach him that they don't appreciate his looney tunes antics either. Why he was so dumb as to deliberately point me to what I already knew about I don't know but since he did that is now his problem.

Of course, spammers, liars or cybersmearers are never too smart to begin with.

Today I am bringing you a small sample of the mad ravings "concerned citizen" puts on his message forum, PCMHOLDINGS.COM and to which he tries to lure the unsuspecting.

Concerned Citizen is obviously a mainiac and easily capable of far more depraved actions than even Michael Jackson is currently on trial for purportedly having done. He is a danger to society and obviously a cyberstalker.

Hang on to your hats and fasten your seat belts because this one is going to be a wild ride indeed. Here is a very small part of a "story" he wrote on pcmholdings.com and desperately wants you to go read all about his great work as an author.

Spinning through the dark dingy center of his/her empire, MayMay began to woolgather thinking of a wonderful time at a special cantina in ole Mexico.

1974 Tijuana

The shrill feedback shocked the senses and rattled the acrid smoky air of the old bar in the crappier section of TJ. “Testes Testes Uno Dos Tres” said a short man in the center of the stage, mildewed torn curtains behind him, micorphone stand 3 feet off the stage,.“Buenos noches amigos” said the MC a dwarf with a club foot wearing a suit he should have abandoned 20 pounds ago. “Hwelcome to our chow” He grinned a piece of spinach lodged in his yellow bicuspid , his full slicked back hair radiant with the spotlights, “ Tonight our Chow ees called “The Bride of the Burrrrrro”

The donkey’s brays could be heard back stage, but it was the sheep’s bah that drew Phil’s attention.

“Hwe need a volunteer amigos to romance DULCITA! At that the spotlight shown on a young lamb wearing a push up bra and “Hanes for Her” probably purchased at a store for muchachas grandes.

Phil was drunk enough and the lamb looked hot, what the hell he thought and throwing caution to the wind he arose and walked toward the stage as a group of sailors on shore leave began to chant “Do It!”

Stumbling out the rank saloon, Phil steadied himself if only to avoid the rain of fists that would befall him if he neared the sailors. The room which previously smelled of sweat, beer, cigarettes, despair, cheap perfume, and livestock now reeked in a twisted potpourri of the previous now spiced with gore and cordite. (Ed Note- Foxy what a twist)

Death awaited the depraved pervert if he stayed a moment longer. His breath smelled like a jet of Binaca sheep scent. A toothless old prostitute spat at his face which only made him grin. He loved this town. His desires unsated he entered an S and M bar next door. "La Painadoria"

Inside a butch bull dike with a leather Nazi officer cap sneered as he entered his eyes now adjusting to the low light. Suspended from the ceiling by his nipples pierced by talons a la Richard Harris in "A Man Called Horse", hung a young man of Phillipino descent spinning in slow arcs. Ordering a cheap beer from a one-eyed waitress, Phil got comfortable and took in the spectacle around him.

CREDITHAMMER relaxed as he took in the scenery. He wasn’t aware of the sailor who had walked in a few minutes later.

The Sailors had watched him as he sulked away from the cantina and snuck into the LaPainadoria. They were talking about what they would like to do with the mean old fool when a young sailor had arrived late on the sceen. He was late, but his buddies filled him in on what had happened.

The particular sailor was from Northern California.

He grew up on a farm which raised sheep for their wool. He had many a lamb as a pet.. He considered them friends. He loved animals and detested the idea of anyone mistreating them. It broke his heart when they told him what had happened.

He was happy to hear that the burro had managed to knock out the MC and push CREDITHAMMER down, before CREDITHAMMER had shot him to death. He swelled with pride for the burro.

He despised the cruel man who had shot the burro and the lamb. He loathed CREDITHAMMER for everything that he represented.. He wanted to revenge the horrible death of the two poor innocent animals.

He was enraged.

The sailor thought that his buddies had described the brutal old man well. He spotted him immediately, snickering over a drink and laughing at something. The ‘something’ was a poor helpless young man who was suspended from the ceiling and spinning in low arcs. He could not believe his eyes as he realized that the young man had talons hooked into his flesh. The young man was desperately pleading for someone to help him.

The sailor immediately jumped onto the bar and with his Swiss army knife swiftly cut the young man down. The young man fell to the ground and cried “Thank you. Thank you.. these freaks are crazy.. help me.. help me.. please help me get out of here”. The sailor was in the process of helping the young man up and telling him that everything was going to be okay, when all of a sudden the bull dike with the Nazi officer cap approached them and said “What the hell do you think you’re doing here”?

The sailor could not bear the sight of the bull dike with the Nazi cap. He could care less about her sexual preference, but he would not tolerate anyone wearing a Nazi cap. He had read “Ann Frank” several times while at school, and had great sympathy for all of those who had suffered at the hands of the hateful Nazis. He walked toward her and quickly grabbed the cap off of her head and tore into pieces, and threw them into her face.

The woman shocked.. started screaming obscenities and proceeded to lash out with her big fists in a futile attempt to beat up the sailor. The young man who was cowering behind the sailor had started to scream. The sailor pushed the big woman down and picked up the young man and ran out of the bar with him.

Throughout it all the vile CREDITHAMMER sat in audience. He was thoroughly disgusted with the sailor for interrupting his fun and spoiling what his sick mind considered to be his entertainment.

But some freak intuition of his own told him that he had lucked out.. told him that the sailor had actually come into the bar for him.. told him that if it had not been for the sailor’s timely rescue of the poor tortured soul suspended from the ceiling, it would have been he himself who would have been carried out of the bar.

He was moping about the unbelievable bad luck he was having that day, as he crept out of the bar of ill repute..

The phone rang, bringing him back to the present. Still dressed as MayMay69 Phil couldn't pick up the phone. 6000 visits to his website and not one sale. These idiots didn't know what was good for them. Pensively, he looked up the blog of his arch Nemesis, C. Tormis. Filled with a combination of dread he waved his arms above his head dreamily, like Bette Davis in "What Ever Happened to Baby Jane?" Dancing around the room he turned on his VCR. Richard Simmonds was flouncing and dancing with a crew of whalish housewives. An idea brought forth its own genisis in the surviving neurons in his cranium. "That's it!" "The Credithammer DVD!" He envisioned himself on commercials like the guy that wears the suits with question marks like the Riddler that sells books on getting government grants. I will make a video and at that he danced dervishly like Richard Simmons on amphetimines.

But before I can begin production, Phil proclaimed, I must continue to try and find all the newsgroup postings about me and respond to them like I did yesterday here. Rats, more people finding out the truth about me.

CREDITHAMMER searched stealthily through all of the newsgroup

postings and responded to them as quickly as possible..

He hated C. Toris with every fiber of his being. He couldn’t help the tears that were falling from his eyes and messing up his cheap mascara. As he wiped away the tears, he thought.. “Darn, This guy is going to put me out of business! How can I scam unsuspecting people.. and rip them off with my mis-informed credit advice, when C. Toris is telling them THE TRUTH about me? And how am I gonna get any money from these gullible and trusting people with my fire scam, when C. Toris tells everyone THE TRUTH about it all being a bogus ploy to pilfer money from them"?

CREDITHAMMER resigned himself to yet another task of systematically typing ridiculous and irrationable responses, hoping to salvage himself another "student"..

He climbed into the Ford Pinto, avoiding jagged metal and peeling faux wood trim. He was on his way to Best Buys with one of his two remaining lines of credit. His Mowes card long since toast, but he had that secured Cap One card and a man on a mission would get some fancy AV equipment and voice recognition software with that Best Buy plastic. He envisioned the CreditHammer(TM) program with his face as the spokesman as being a surefire hit. MayMay69, Jeffe, Wagg, and Goosegow1 would certainly want to be in the film. That Jeffe needed to be on a shorter tether by cracky, Phil was alarmed by the Jeffe since he started getting instructions directly from God spoken to him through cats. Entirely different matter.

He pulled in to the first handicapped spot. Not that he was incumbered in any way, he just didn't give a crap. He grinned big thinking of what was to come.

Cybersmears - What they are and how to deal with them

How Cybersmearers Amplify Their Message **

The perpetrators of Cybersmear (or what is referred to as Internet Terrorism), are prone to predictable patterns. Most common among these is the strategy of amplifying a complaint or several accusations in an attempt to lend credibility. This is done largely through what we call “proliferation and amplification.”

The goal of an Internet Terrorist is to inflict harm on the target company or individual. This is done through what must seem to be credible information that also must appear to be large and prevalent.

Here are the consistent tactics of Cybersmearers on-line:

• Anonymous postings on scattered “chat rooms” and/or bulletin boards.
• Look for postings chronicling the “injustices” of the accused company in what appears to be detailed “bashing” or techno-discussion. Look for (amateur, unlicensed) interpretation and conclusions.
. Look for information or quotes taken out of context from the accused, or represented in very small segments as to be presented in a more misleading manner.
• With very few exceptions these basher will claim a concern for “innocent victims” or the “unsuspecting customer”.
• With few exceptions these bashers will claim a “neutral” stance, but will solicit either comments or emails which will predominate in the direction of the Smear (this is key to identifying a smear. True neutral discussions open to the public generally occur with both positive and negative viewpoints equally represented. If the balance is tilted too far in one direction, it is the fingerprint of a smear, and the posted comments can safely be considered false).
• It is common for all of the comments to be anonymously posted by the perpetrator(s) to create the sense of “unified outrage” or “a virtual stampede of individuals who agree” or “surprising public outrage” (all actual quotes).
• Further, perpetrators will anonymously post slightly varying opinions (all in the direction of the smear, of course), so a “discussion” can occur on finer points of the smear, all the while creating the impression of a larger complaint field.
• Among what is usually a small circle of smear perpetrators (generally ten or less individuals behind the largest and most famous smears), automatic posting notifications are sent out whenever one individual places new content on the Internet. This allows the others to rush to the scene with their anonymous postings, again, providing amplification and a false impression of the scope of the complaint.
• The band of smear perpetrators will carefully interlink their sites (to a controlled result, over linking is punished by search engines) so that their websites receive high ranking in search result pages.
• Key words, many times the company or personal name of the accused, will be used in the bashing of titles, body of text, and Meta tags so that someone searching for the accused will automatically find the Cybersmear websites. In this way, the smear is made known to those searching for the accused company or individual.

Folks, the list of spam messages this joker puts out is absolutely endless. More than 120,000 of them and still we keep on getting more from this spam monkey. The best I can do is try to make everybody aware of his false and misleading posts and information and let him ruin every message board, newsgroup, egroup and the entire web with his garbage.

Why do debt collectors fear the truth? Because if everybody understood what happens when you pay them they woud never collect a crying dime. They will never give a receipt for any money you pay them and that is because the money they get cannot be easily traced or tracked and it is much easier for them to steal from their clients, turn the debt over to another collection agency who will attempt to collect from you again even though you paid the debt already. They also will be less likely to get caught at their thievery. But that is why most states have licensing laws in place to help protect the creditors who trusted them to collect the money.

Debt collectors will never take it off your credit reports either. Makes no difference whether you pay them or not. So never pay a debt collector thinking that is going to help your credit ratings. While it might give you a very small boost because your debt to income ratio will be improved that won't overcome the negative effect of having debt collector skunk spray all over your credit reports.

Recently, in an agreement with many credit professionals, Uncle Normie threatened:

Unable to maintain any professional demeanor, even on a message forum, Uncle Normie is only able to resort to harassing threats to support his postions. This is the primary reason he has been banned from all other credit forums on the internet. The secondary reason is his continued insistence on spreading false and misleading information as I have pointed out numerous times on this blog

The courts define harassment as "repeated, unwanted contact from a person or group of people". Uncle Normie's suggestion that he will enlist numerous others to disrupt the current friendly atmosphere of a particular message board, certainly fits the legal definition of harassment.

In recent years, the courts have extended to internet communications, the Federal stalking and harassment statutes including 18 USC § 2261A and 47 USC § 223. In fact, the landmark case of United States v. Young, 1999 U.S. App. LEXIS 32721 (4th Cir. 1999) led to the ammendement of the above statute to include the internet.

Uncle Normie is now treading on very thin ice. The resources of this board run deeper than he might imagine. It isn't confined to a group of scumbags living paycheck to paycheck who's only concern is how to avoid appearing on caller IDs that he is used to. I would imagine that, with little provocation, there are a number of people that would be willing to take appropriate legal action against him for his recent threats.

As he advertises on his website, Uncle Normie advocates suing debtors for violating the law. However, he fails to see how he himself is not above the law.

He was pretty deaf by that time and he couldn't hear the engine run on that new car so he would race the engine real hard and keep his foot on the clutch to control the speed. That way he could listen to see if the engine was still running or not. He buned the clutch out of that new car in about 2 weeks and went around hollering about how they don't make cars like they used to.

Anyone who happens to run into Uncle Normie or his boob postings should be aware that he is a debt collector and is therefore a member of the collection industry which is well known for being mostly comprised of kooks, sex perverts and a vast array of other types of mentally deranged people who really ought to be incarcerated in a mental institution or prison rather than being allowed to prey on those who have fallen behind on their bills for whatever reason.

Creditwrench put up an article on which was copyrighted and then rode herd on unclenormie until he got word that Uncle Normie had ran over to that other website and brayed about how the wrench had copied their material and put it on his blog. As luck would have it, the notice came about Normie's post on that other website about 10 minutes after the Wrench had posted the stuff on his blog so he quickly replaced it so that Normie was turned into a liar yet once again. Uncle Normie will never learn.

Normie hollering about Creditwrench after having had stolen and mutilated copies of Newsweek on his blog and the Wrench caught him and reported him to Newsweek's legal team..

As has been stated numerous times on his blog, CREDITWRENCH CEO Bill Bauer is not in the business of credit repair.

Without knowledge of the basics of the FCRA, one has no hope of removing inaccurate information on their credit report or at least that Normis knows anything about. Yet Uncle Normie keeps on braying that CREDITWRENCH advertises he repairs credit ala Bud Hibbs, John Ghila, and others he emulates. Uncle Normie's claim to fame is hilarious. He claims to have links that he don't have but links don't mean anything unless those links have what is known as link popularity and are properly done. He claims that he is going to bring in lots more big guns in his fights with Bill Bauer but he before he can actually do that he has to know what the big guns are and how to use them. One of the big guns is known as link popularity.

Since he obviously don't know what it is he also don't know how to build it and that is evidenced by the fact that he don't have any. And since Bauer started his blog at the same time Normie started his one would naturally think that if Normie knew anything about link popularity he would be trying to build some and in fact would already have some. The John Gliha Scam and Uncle Normie

Those who believe either John Gliha or Uncle Normie are suckered into similiar situations. I will explain once you understand the scams of John Gliha. One poor person suckered by John Gliha reveals what happened to him.

I have personal experience with one of the ’debt cancellation’ programs and I must say that I am totally discouraged. It is true that some high visibility cases have attained success, but I would bet that there are many, many more that are unsuccessful. If you plan to be successful in this endeavor, you had better have had some legal training and you had better have deep pockets.

Let me explain. The company that I decided to go with stated that the program would cost $1500.00. They failed to tell me that it would cost an additional $680.00 to have the four accounts arbitrated, which they ’suggested’ as the best thing to do. We, through conference calls, were also told that hardly anyone ever needed more than the 5 hours of consultation that was provided in the $1500.00 fee. But, after having spent the $2180.00, and having been sued by one of the banks, I found that I needed to buy another 5-hour block of time for another $790.00. Well, that about broke me and so I ended up having to go to court to fight a Motion for Summary Disposition, using tactics told me by the company, and was judged against. So, I filed a Motion to Vacate the Judgment, which I had to do on my own since my time with the company had run out and I had no more money to pay them. So, they left me high and dry. My Motion to Vacate was denied and now I cannot appeal because I would have to put up a bond in the amount of the judgment. And I certainly cannot afford that. Which just goes to show that justice is obviously for sale in this country. If you have the money, you might get justice. But, if you don’t, you certainly won’t.

The thing that sticks out to me is that the judge did not consider the arbitration ruling at all. This was my defense in the initial Motion for Summary Disposition. The banks attorney convinced her that the arbitration panel and the ruling were frivolous. And my Motion to Vacate that judgment was also considered frivolous by the judge even though I showed her many cases and USC codes that prohibit banks from lending credit. I also showed that the bank could not show an account from which money was taken to loan to me. The idea being that no money was loaned and banks cannot loan credit and therefore the contract was null and void. All the opposing attorney had to do was mention the word "frivolous" and the judge agreed.

Anyway, I thought you might be interested in what is really going on in this area. If you don’t have the money to pursue it and you are not trained in legal matters, your chances of success seem to be small to none.

Now that we understand the consequences of being victimized by the infamous John Gliha let us examine the fraud Uncle Normie is trying to foist upon you.

He wants you to believe that Bill Bauer and his CREDITWRENCH program is also a credit repair scam just like that of John Gliha. Of course, nothing could be further from the truth because neither John Gliha nor Creditwrench provides any credit repair services at all. John Gliha teaches that the banks and credit card companies defraud the consumer so the consumer has the right to defraud the banks.

Creditwrench teaches about abusive debt collectors and attorneys who break the law with impunity and get away with massive abusiveness of the consumer and our legal system. Creditwrench teaches that if one is to reach a satisfactory conclusion to an indebtedness problem one must always know and understand the law and work within the legal system as it exists rather than attempting to circumvent it with junk legal theories. We are a nation of laws. All of us are subject to the law and none are above the law. So it behooves us to know and understand the law and how it works if we are to avoid being a victim of our own ignorance.

It is not necessary to be a lawyer or spend all of one's life to be able to understand that part of the law necessary to deal with any one particular situation that we might be facing. Creditwrench does not teach any false legal theories found on message forums or websites but rather teaches that each of us must do our own homework and our own research even if we plan to hire competent legal professionals to represent us in any given situation.

Attorneys are usually competent and well versed in their fields of specialization just as are most doctors. But one cannot realistically expect a proctologist to be qualified to operate on a brain tumor nor can one realistically expect an oil & gas attorney to be competent in FDCPA, FCRA and other debt related matters. So, in order to know whether or not an attorney is "competent" one must first of all know what field(s) the attorney under consideration is competent in. The only way to determine that is to know enough about the law to ask intelligent quetions of the attorney before retaining his services.

Even then one must be able to provide the attorney with sufficient evidence of misconduct on the part of your opponent to enable him to put a solid case together for you.

These are the kinds of things that Creditwrench teaches, not credir repair nor debt elimination. Creditwrench teaches that if one knows the law the law will set you free, not Uncle Normie and his false and misleading interpretations of creditwrench and what it does or does not do.

CREDITWRENCH and trademark registration

CREDITWRENCH CEO Bill Bauer has advertised on his website/blogs and even posted to message boards, the name CREDITWRENCH followed by ®. This would indicate that CREDITWRENCH is a federally registered trademark and properly filed with the US Patent and Trademark Office.

However, the USPTO has no record of any such registration.

Quoting from §906.04 issued by the USPTO, "use of a federal registration symbol that is deliberate and intended to deceive or mislead the public is fraud".

Now why isn't it suprising that CREDITWRENCH has committed fraud? Well for one thing, it's his specialty. He advertises that he does credit repair, but because he's not compliant with federal statutes in the operation of a credit repair business, he then denies it. He claims to be incorporated in the state of Oklahoma, however CREDITWRENCH is not registered with the Oklahoma Secretary of State as a corporation.

Those 3 things alone show that CREDITWRENCH is nothing more than a scam indended to bilk unwary consumers of their money.

Power of sale and Oklahoma statute

Notice to the Oklahoma State Senate Ethics Committee:

It has come to my attention, through a credit repair blog of CREDITWRENCH CEO Bill Bauer, that certain Oklahoma State Senators are unfamiliar with the power of sale provision under Oklahoma Statutes, specifically Title 46.

My appreciation of the wording of Title 46 is that it allows for nonjudicial foreclosure. CREDITWRENCH CEO Bill Bauer, however, indicates that legal advice given to him by three Oklahoma State Senators proves otherwise.

Although Mr. Bauer refused to provide the names of the senators involved, I felt it important to bring this matter to your attention. With all due respect, I would ask that you either clarify to all Senators that Title 46 indeed provides power of sale to a mortgagor, or ask them to pass legislation to ammend the wording that indicates it does.

On one of his credit repair blogs, CREDITWRENCH CEO Bill Bauer claims that because of his knowledge to vacate a judgment he would never have to worry about having a foreclosure on his house.....again.

Not so if he planned on buying a home in Oklahoma. Oklahoma is a nonjudical foreclosure state. That means when you buy a home there you execute a power of sale when you sign the mortgage note. If you default on the mortgage, the mortgage company can foreclose on your home without ever even going into a court room. There is no judgment, therefore no judgment to vacate.

If you don't cure the default, the sheriff shows up and escorts you off the property which now belongs to the mortgage company to auction off. Now instead of building equity in your own home, you're trying to find a place to rent. And renting is like pissing away money.

CREDITWRENCH CEO Bill Bauer stating you can vacate a judgment to avoid losing your home in a foreclosure proceeding is false and misleading.

Seems rather low considering that I am, at this moment, reading today's Wall Street Journal and they quote today's prime interest rate at 5.50%. (Prime interest is what banks charge their most creditworthy corporate customers.) Wonder how an Oklahoma City BankOne is able to charge credit-risk customers less than prime.

Additionally, it seems his BankOne is earning and paying interest on pledged security contrary to federal banking regulations.

We'll delve into this matter futher tomorrow, as right now I'm working on some other false and misleading credit repair claims made by CREDITWRENCH CEO Bill Bauer.

The peculiar (and annoying) tendency for the ignorant and irresponsible to nitpick and quibble manifests itself in three distinct ways: back-seat driving, armchair quarterbacking and carping.

Every single measure taken by the CREDITWRENCH to wage the war on abusive debt collectors and the credit bureaus has been opposed by the Uncle Normie. Yet he has no strategy, no plan, no proposals other than "everything CREDITWRENCH has done is wrong." Let's examine the Uncle Normie's complaints about CREDITWRENCH, and see what pattern emerges. The nature of the debt collectors and their terroristic threats demand that some techniques which are legal to be used be put to good use by consumers. These measures, signed into law by Congress, or devised by the simple application of good old common sense have been overwhelmingly opposed by "Uncle Normie" and his cohorts. It is the height of hypocrisy to claim that the war cannot be won by CREDITWRENCH methods and then fail to come forth with his own proposals and plans if indeed he had any.

Information is intelligence but "Uncle Normie" obviously has little enough of that indeed. Intelligence is information, it is not action. Knowing where your enemies are is useless until you do something about it. Debt collectors depend on consumer ignorance and frustration to accomplish their ends and maintain their funding. In order to defeat debt collector terrorism, we must learn from those we can trust to provide good information and teach us how to use it in a common sense way and not by the application of false and misleading information to junk legal theories.

Before, and during, the present time when a new and loudly braying jackass appeared on the scene embodied in the corpus delecti of one "Uncle Normie" and said it could not work, would not work, and should not be done CREDITWRENCH methods have and will continue to be the standard of excellence which others seek to emulate.

"Uncle Normie" is nothing but an amusing but clearly befuddled creature who has nothing better to do and will soon pass on to other less challenging enterprises.

Making Mountains Out of Molehills

"Uncle Normie did his usual rabid attack on CREDITWRENCH today (12/15) , completely ignoring -- as usual -- most of the FACTS of the story. If "Uncle Normie" were "reporting" that the sun rose this morning, he'd try to make it sound like a shocking scandal, unprecented in the annals of humanity. Here is his latest shot at shame:

CREDITWRENCH proposes an idea to improve your credit rating here. Problem is, not only will it do very little, if anything, to improve your credit, it will prove to be disasterous on your financial situtation.

He claims in his message that this is his idea and it's copyrighted. First of all, you can't copyright an idea, secondly this scam as been around longer than his scam.

This scheme involves borrowing $1000 from a bank by putting up $1000 dollars of your own money as security, then using the banks money to deposit in another bank etc., etc.

So what's the bottom line? This scam was created ages ago before the advent of the FICO scoring system used today by all creditors to determine, not only creditworthiness, but as a measure of what to charge for interest.

If you're in a situation that you're considering using a credit repair method such as this one proposed by CREDITWRENCH CEO Bill Bauer, your FICO score is most likely in the 450-550 range.

With a score in that range, you will find yourself paying around 15% interest on a secured loan. Now keep in mind, you are actually borrowing $3000 using his 3 bank trick. Doing a quick calculation of 15% on $3000, and that's only compounding it once annually, you will pay $450 for this $3000 in loans. Almost 1/2 of your $1000 deposit wiped out in just 12 months to play his silly "trick". As you can see from the math, the trick is on you.

He say's that the cost of the loan would be offset by the interest earned. Wrong again. First off, banks do not pay interest on their security. Anytime you use cash as security it is put into an escrow account, not a savings account.; it draws no interest for you.

At the end of 12 months you lose 1/2 your savings and this type of account being paid in full will have marginal, if any affect on your FICO score.

His statment has absolutely no basis in law or the FDCPA. That's like saying if you run a red light, and hit another car because your brakes fail, you can avoid being sued by getting your brakes fixed.

The FDCPA is a strict liability statute, and as such, a consumer has the right to sue under statute for any violation, regardless of subsequent remedial actions taken.

Yet another false and misleading statement contained in CREDITWRENCH Bill Bauer's "copyrighted" credit repair here, is:

Print my 100 word statement in it's entirety exactly as I have worded it and distribute my 100 word statement to each and every company who has ever requested my credit report during the last two years.

The FCRA only requires them to send an updated report to company's who requested your report in the last 6 months, not 2 years. The 2 year requirment applys only to reports used for employment purposes, not credit. If CREDITWRENCH CEO Bill Bauer had ever done any research rather than relying on message boards for his information, he would have known that.

CREDITWRENCH stating a credit reporting agency must distribute an updated credit report to any company that requested your credit report for the last 2 years is false and misleading.

Based upon the factual information that CREDITWRENCH CEO Bill Bauer apparently optained from this blog, he made an edit in the credit repair section of his message board from his original credit repair advice given here.

This recent edit includes a statement to the effect that "a credit repair student of his recently attempeted the use the CREDITWRENCH credit repair technique he advertises". In doing so, the credit reporting agency revised the statement he submitted, just as Uncle Normie indicated would happen to anyone attempting to use the CREDITWRENCH credit repair technique.

Now, isn't it a coincidence that this happened exactly one day after I exposed his erroneous credit repair advice? Unlikely. It's either happened before and CREDITWRENCH CEO Bill Bauer, in attempt to solicit customers to his credit repair business, failed to disclose it, or it's another lie.

Whichever scenario it is, it is false and misleading credit repair information.

In my prior post I brought to light one of the methods CREDITWRENCH Bill Bauer proposes to repair credit. Regarding this particular method of credit repair he claims "I've never had it fail yet." That statement is an obvious lure for an unwary consumer to subscribe to his credit repair methods.

Here is why it will always fail:

The entire scheme hinges on his statement that:

FCRA states that they must print your 100 word statement and have no right to change or modify it in any way.

The FCRA states no such thing. In fact it states just the opposite:

Section 611 (c) states: the consumer reporting agency shall, in any subsequent consumer report containing the information in question, clearly note that it is disputed by the consumer and provide either the consumer's statement or a clear and accurate codification or summary thereof.

As you can clearly read, the Credit Bureau can, and in the case of obvious credit repair scams, will summarize the dispute for you.

The Credit Bureau's know much more about the FCRA than does CREDITWRENCH CEO Bill Bauer. In fact, he has stated in the past that he knows nothing about it, which should be obvious from this example.

Even though the Credit Bureau is entitled to summarize your statement of dispute, if you use the CREDITWRENCH method, you will likely cause yourself more damage and end up without any statement of dispute. Why? Because the FCRA also says they don't have to include a dispute statement if "there is reasonable grounds to believe that it is frivolous or irrelevant. Certainly CREDITWRENCH'S "copyrighted" letter is both frivolous and irrelevant.

On his message board, CREDITWRENCH CEO Bill Bauer gives the following credit repair advice:

As an example of when and how to use this CREDITWRENCH method, here is an imaginary instance. Let us imagine that the credit bureau is reporting that you owe $10,000 and the truth is that you only owe $1,000 so you send the following 100 word statement in a letter which gives them two options.

1. Remove the listing entirely
2. Print my 100 word statement in it's entirety exactly as I have worded it and distribute my 100 word statement to each and every company who has ever requested my credit report during the last two years.

He then goes on to provide his "copyrighted" consumer statement, which in part states:

(Credit Bureau)...is falsely reporting inaccurate and incomplete information...In doing so, (Credit Bureau) is knowingly defrauding you...probably does contain false and inaccurate information.

This idea of asking the Credit Bureau to insert a comment that they would find demeaning, and therefore opt to delete the tradeline instead, is an old favorite of credit repair scams and has been around forever.

According to CREDITWRENCH's credit repair advice, the Credit Bureau must include this statement, and has no right to change or modify it. Additionally, that you can request it be distributed to every company ever requesting your credit report during the last two years.

CREDITWRENCH CEO Bill Bauer's credit repair advice from his message board quoted above is false and misleading. In my next post, I will point out the numerous reasons why.

CREDITWRENCH admits to RICO violations

On this blog CREDITWRENCH CEO Bill Bauer has unwittingly admitted to a violation of the Racketeer Influenced and Corrupt Organizations Act, better known as RICO. Because, as has been previously pointed out in this blog, CREDITWRENCH CEO knows nothing about RICO, he was most likely unaware of this flagrant violation. However, his ignorance of the law doesn't lessen his liabililty under Federal Law.

On his blog, CREDITWRENCH CEO Bill Bauer states:

The Wrench now has the ability to file reports.....(with) all 3 major credit bureaus. What this means is that by working with a major national collection agency who is interested in helping to clean up their industry our students will now (as always) be keeping track of the FDCPA and FCRA violations of the collection agencies who contact them in the process of collecting debts and will be reporting the violations to me and the contacting agency will be charged $1,000 per violation.

There was no obligation incurred by the collection agencies in the above scenario. CREDITWRENCH has no legal standing to collect $1,000 per violation in the above scenario, and neither do any of his unfortunate students.

However, he continues to try to sell people on his credit repair scam using exactly the tactics he describes above. The collection agency he mentions as wanting to "clean up their industry", and his "students" are accomplice's in creating these false debts and are as equally as guilty of RICO violations as is he.

Only a court of law can award statutory damages. CREDITWRENCH CEO Bill Bauer's advertisement that he is attempting to collect invalid and illegal debt is a clear RICO violation. And, is nothing more than a false and misleading attempt to lure unsuspecting consumers into his credit repair scam.
